Construction Excluded from New Living Wage Law Paul Sugar, Ober, Kaler, Grimes & Shriver
Maryland's Living Wage law became effective October 1, 2007. The statute does not apply to contracts for construction or for construction related services. That statute applies, with certain exceptions, to state contracts for other types of services. Under the statute a contractor who provides services to the state must pay its employees a "living wage." Contractors who perform services in Montgomery, Prince George's, Howard, Anne Arundel and Baltimore Counties and Baltimore City, known as "Tier 1" areas, must pay employees at least $11.30/hr. if the services performed in the Tier 1 area are valued at 50% or more of the total value of the contract. In the rest of the state employees, must be paid at least $8.50/hr. Rate adjustments are available if the employer provides health insurance. There are penalties if the employer fails to comply with the statute. The statute will be enforced by the Commissioner of Labor and Industry and regulations are being drafted. Got questions? Drop Paul an email at pssugar@ober.com.
